No.100943) a registered Qatari-Multinational company headquartered in the city of Doha, State of Qatar, a jointly owned business registered as a company with limited liability (L.L.C.) in the State of Qatar. Indemnification

You agree to indemnify, defend and hold harmless SERVE®™ CORP. W.L.L. DESIGN & CONTRACTING – Qatar  and/or “cadengineering-ltd.com”, our affiliates, and our respective officers, directors, employees and agents (each an “Indemnified Party” and, collectively, the “Indemnified Parties”) from and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings (whether legal or administrative), and expenses (including, but not limited to, reasonable attorney’s fees) threatened, asserted, or filed by a third party against any of the Indemnified Parties arising out of and/or relating to (i) your use of our Services, (ii) any breach or violation by you of this Agreement; and/or (iii) any acts or omissions by you. The terms of this section shall survive any termination of this Agreement.

One or more patents owned by SERVE®™ CORP. W.L.L. DESIGN & CONTRACTING  apply to the SERVE®™ Services and to the features and services accessible via the SERVE®™ Services. Portions of the SERVE®™ Services operate under license of one or more patents. (see a non-exhaustive list of applicable SERVE®™ patents and applicable licensed patents).

LICENSE AND ACCESS

Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees, SERVE®™ or its content providers grant you a limited, non-exclusive, non-transferable, non-resalable, non-sub-licensable license to access and make personal and non-commercial use of the SERVE®™ Services. The licenses granted by SERVE®™ terminate if you do not comply with these Conditions of Use or any Service Terms.

YOUR ACCOUNT

You may need your own SERVE®™ account to use certain SERVE®™ Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. Click here to manage your payment options. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. SERVE®™ does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the SERVE®™ Services only with involvement of a parent or guardian. Parents and guardians may create profiles for teenagers in their SERVE®™ Household. Alcohol listings on SERVE®™ are intended for adults. You must be at least 21 years of age to purchase alcohol, or use any site functionality related to alcohol. SERVE®™ reserves the right to refuse service, terminate accounts, terminate your rights to use SERVE®™ Services, remove or edit content, or cancel orders in its sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You grant SERVE®™ and sub-licensees the right to use the name that you submit in connection with such content, if they choose. INTELLECTUAL PROPERTY COMPLAINTS

SERVE®™ respects the intellectual property of others. And while we outsource many services, materials from third parties such as web design, web development, web content, marketing content, texts, photos, videos, media and others we have no control or knowledge on the source of these materials that may appear on any of our websites, networks, platforms and/or publications. We SERVE®™ claim no liability and/or responsibility towards any party for any material copyright infringement which may appear on any of  our websites, networks, platforms and/or publications. RISK OF LOSS

All purchases of physical items from us are made pursuant to CPT & CFR incoterms and/or of a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the first carrier.

RETURNS, REFUNDS AND TITLE

SERVE®™ does not take title to return or refund for any items, material and/or service purchase by you from us through any of our websites, networks, platforms and/or publications.

PRODUCT DESCRIPTIONS

SERVE®™ attempts to be as accurate as possible. However, SERVE®™ does not warrant that the product, material and/or service descriptions or other content published or stated on any of SERVE®™ Services are accurate, complete, reliable, current, or error-free. If a product, material and/or service offered by SERVE®™ itself is not as clearly described, it is your sole responsibility to inquire for more clarification from us before making your purchase.

PRICING

Price shown on single product, material or service window and/or “List Price” means the suggested retail price of a product material or service as provided by a manufacturer, supplier, or seller. We regularly check these Prices against prices recently found on SERVE®™ and other retailers. Certain products, materials or services may have a “Was Price” displayed, which is determined using recent price history of the product on SERVE®™.

With respect to some custom items, materials or services sold by SERVE®™, we cannot confirm the selling price until you provide full description of the item, material or service your want to purchase and request a recent quote from us. Despite our best efforts, a small number of the items, materials or services in our websites may be mispriced. If the correct price of an item sold by SERVE®™ is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation and refund your payment. DISPUTES

Any dispute or claim relating in any way to your use of any SERVE®™ Service, or to any products or services sold or distributed by SERVE®™ or through “CADENGINEERING-LTD.COM” Should be lodged, addressed & submitted first at SERVE®™ CORP. W.L.L. DESIGN & CONTRACTING HQ in Qatar and attempt to resolve it amicably prior to any other administrative and/or legal authorities, in case of failure to achieve a satisfactory solution and/or compromise, then  the dispute or claim shall be referred to and resolved by Courts of State of Qatar.

Before begin arbitration, you must send a letter requesting arbitration and describing your claim to our registered legal agent.

GOVERNING & APPLICABLE LAW

This Agreement “Terms & Conditions of Use” and the use of SERVE®™ Services shall be governed by the laws of the State of Qatar, you expressly consents to the personal jurisdiction of the State of Qatar and courts located in the State of Qatar for any dispute, claim or any matter arising from or related to this Agreement and/or use of any of our services regardless conflict of principles of laws in different jurisdictions.
